Welcome to Kloqride, an on-demand cab booking platform developed to make your travel easy, safe, and convenient. Please read these Terms of Service ("Terms") carefully before using our mobile application or website (collectively, the "Service"). By accessing or using Kloqride, you agree to be bound by these Terms.

1. Acceptance of Terms

By registering, accessing, or using Kloqride, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our services.

2. Eligibility

You must be at least 18 years of age to use Kloqride. By using the app, you represent and warrant that:

  • You are legally eligible to form a binding contract.

  • All registration information you submit is truthful and accurate.

3. User Account

To book rides or provide driving services via Kloqride, you must create an account. You agree to:

  • Provide accurate and complete information.

  • Keep your login credentials secure and confidential.

  • Notify us immediately of any unauthorized use of your account.

You are solely responsible for all activity under your account.

4. Ride Bookings

Kloqride connects passengers with nearby drivers. While we facilitate the connection, we are not a transportation provider. All transportation services are rendered by independent third-party drivers.

You agree that:

  • Ride fares, cancellation fees, and applicable taxes will be shown before confirming the ride.

  • You will treat drivers/riders respectfully and comply with all applicable laws during the trip.

5. Payments

All payments are processed via secure third-party payment gateways. You authorize Kloqride to charge your chosen payment method for completed rides and applicable fees.

Cancellation Policy: Cancellation charges may apply if a confirmed ride is cancelled after a certain duration. These will be shown at the time of booking.

6. Driver Terms (For Drivers Only)

If you are a registered driver:

  • You must provide valid documents (license, registration, insurance).

  • You agree to drive safely, follow traffic laws, and maintain a clean, roadworthy vehicle.

  • Kloqride may suspend or terminate your access in case of misconduct or non-compliance.

7. Prohibited Activities

You agree not to:

  • Use the app for unlawful or fraudulent purposes.

  • Harm or threaten other users.

  • Tamper with the app or attempt to reverse engineer it.

  • Post or share offensive or misleading content.

8. Suspension & Termination

We may suspend or terminate your account if:

  • You violate these Terms or applicable laws.

  • We detect fraud, abuse, or misuse of the Service.

You may also delete your account at any time from within the app.

9. Limitation of Liability

Kloqride is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free service. We are not liable for:

  • Any damages or losses arising from your use of the app.

  • Any issues between riders and drivers, including delays, accidents, or misconduct.

10. Indemnity

You agree to indemnify and hold harmless Kloqride, its affiliates, and employees from any claims, liabilities, damages, or costs arising from your use of the service or violation of these Terms.

11. Changes to the Terms

We may modify these Terms at any time. Continued use of Kloqride after updates means you accept the revised Terms. We will notify users of significant changes via the app or email.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of Kolkata.
